E&S Grounding Solutions, Inc. ("E&S," "we," "us," or "our") operates the website located at www.esgrounding.com (the "Site"). This Privacy & Contact Policy explains how we collect, use, store, and protect personal information submitted through our website, and describes your rights under applicable law.
We operate two separate contact databases: (1) a newsletter subscriber list for our monthly technical newsletter, and (2) a sales contact list for project inquiries and quote requests. Each list has distinct purposes, consent mechanisms, and opt-out procedures, as described below.
By using our Site or submitting any form, you agree to the practices described in this Policy. If you do not agree, please do not use the Site or submit your information.
2. Information We Collect
We collect personal information only when you voluntarily provide it. The categories of information we may collect include:

4. Sales Contacts & Quote Requests
When you submit a quote request, download our free sales resources, or contact us about a specific project, your information is added to our sales contact list. This list is separate from our newsletter subscriber list.
What we collect: Name, email address, company, phone number, mailing address (optional), project type, and project notes.
Purpose: We use this information to respond to your inquiry, prepare a project proposal, and follow up on your project needs. Sales contact data may also be imported into our accounting software (QuickBooks Online) for invoicing and project management purposes.
Auto-response email: When you sign up via the Sales Information page, you will receive an automatic email containing download links for our free PDF resources. This is a transactional email, not a marketing email, and does not require a separate unsubscribe mechanism under CAN-SPAM. However, you may opt out of all future communications at any time by contacting us.
How to opt out: Email [email protected] with the subject line "Remove Me" and we will delete your record within 10 business days.
5. How We Use Your Information
We use the personal information we collect for the following purposes:

9. CAN-SPAM Act Compliance (United States)
The CAN-SPAM Act of 2003 establishes requirements for commercial email messages sent to recipients in the United States. E&S Grounding Solutions complies with CAN-SPAM as follows:
Identification: All marketing emails clearly identify E&S Grounding Solutions as the sender. We do not use deceptive subject lines or "From" addresses.
Physical address: Every marketing email includes our current physical mailing address: 28202 Cabot Road, Suite 300, Laguna Niguel, CA 92677.
Opt-out mechanism: Every marketing email contains a clear, conspicuous, and functioning unsubscribe link. Opt-out requests are honored within 10 business days. We do not charge a fee or require additional information beyond an email address to process an unsubscribe request.
No third-party violations: We do not send email on behalf of third parties in violation of CAN-SPAM, and we do not knowingly allow others to use our systems to send non-compliant email.
Transactional emails: Auto-response emails triggered by form submissions (e.g., sales resource delivery, training confirmation) are transactional in nature and are exempt from CAN-SPAM's opt-out requirements. However, recipients may still contact us to opt out of all future communications.
10. CASL Compliance (Canada)
Canada's Anti-Spam Legislation (CASL) applies to commercial electronic messages (CEMs) sent to or from Canadian recipients. E&S Grounding Solutions complies with CASL as follows:
Express consent: We obtain express consent before sending marketing emails to Canadian recipients. Our sign-up forms include a clear description of what subscribers will receive and how often.
Implied consent: We may send CEMs to individuals with whom we have an existing business relationship (e.g., past clients, training registrants) for up to 24 months from the date of the last transaction, as permitted under CASL's implied consent provisions.
Identification: All CEMs identify E&S Grounding Solutions, Inc. as the sender, include our mailing address, and provide a functioning unsubscribe mechanism.
Unsubscribe: Unsubscribe requests from Canadian recipients are honored within 10 business days.
No pre-checked boxes: Our sign-up forms do not use pre-checked consent boxes. Consent must be actively given by the individual.
11. GDPR Compliance (EU/EEA)
The General Data Protection Regulation (GDPR) applies to individuals in the European Union and European Economic Area. If you are located in the EU/EEA, the following additional provisions apply:
